Terms of Service

1. Agreement

By creating an account or purchasing an Assay report, you agree to these Terms of Service ("Terms"). These Terms form a binding agreement between you and Digital Venture Studio Pty Ltd ("The Assay", "we", "us"). If you do not agree to these Terms, do not use the service.

2. The service

The Assay provides structured product assessment reports across six dimensions: Product-Market Fit, Technical Quality, Financial Viability, Competitive Position, Go-to-Market Effectiveness, and Operational Readiness. Reports are generated using AI analysis (Anthropic Claude API) applied through The Assay methodology.

We offer three service tiers:

3. Payment

All prices are in US dollars (USD). Payment is processed by Stripe. Your report is initiated only after successful payment confirmation. We do not store payment card details. All sales are subject to applicable taxes where required by law.

4. Refund policy

We offer a full refund if your report has not yet been generated. Once a report has been delivered to your account, we do not offer refunds, as the service has been fully rendered.

If you experience a technical failure that prevents delivery of your completed report, contact us at rickmusial@gmail.com and we will either resolve the issue or issue a full refund at your discretion.

5. Your submission data

You retain ownership of all product information and materials you submit through The Assay intake process. By submitting, you grant us a limited licence to use that information solely to generate your report. We do not use your submission data for any other purpose, share it with third parties (beyond the AI processing necessary to generate your report), or retain it beyond the period described in our Privacy Policy.

6. Report ownership and use

Once delivered, your Assay report is yours. You may use it for any lawful purpose including sharing with investors, co-founders, or advisors. You may not resell, republish, or represent The Assay report as a service you provide to others.

The Assay methodology, scoring rubrics, and report format are proprietary to Digital Venture Studio Pty Ltd.

7. Nature of the assessment

The Assay provides structured analytical opinions based on the information you supply and AI-assisted analysis. Reports are not financial advice, legal advice, or investment advice. Scores and recommendations reflect The Assay methodology applied to the information provided — they do not constitute a guarantee of commercial success or failure.

The quality of the assessment depends on the completeness and accuracy of the information you provide. We assess what you submit; we cannot audit or verify claims independently.

8. Acceptable use

You agree not to:

• →Submit false, misleading, or fraudulent information about your product
• →Use the service for any unlawful purpose
• →Attempt to reverse-engineer, scrape, or systematically extract The Assay methodology
• →Resell or misrepresent Assay reports as your own analytical work
• →Circumvent any security or access controls on the platform

9. Limitation of liability

To the maximum extent permitted by applicable law, Digital Venture Studio Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of The Assay, including but not limited to decisions made on the basis of an Assay report.

Our total liability to you for any claim arising from these Terms or your use of the service is limited to the amount you paid for the specific report that gave rise to the claim.

10. Service availability

We aim to deliver all reports within the timeframes stated for each tier. In the event of a technical failure or service outage, we will endeavour to resolve it promptly and communicate with affected customers by email. We do not guarantee uninterrupted availability of the service.

11. Account termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms. If we terminate your account for a reason other than a Terms violation, we will refund any payment for reports not yet delivered.

12. Governing law

These Terms are governed by the laws of the Australian Capital Territory, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.

13. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
